1. Acceptance of Terms
By purchasing a web design package from Joy Innovations Private Limited, you agree to the following terms and conditions. These terms constitute a legally binding agreement between you and Joy Innovations. If you do not agree to these terms, please do not proceed with the purchase.
2. Design Package Details
Description: The design package includes:
2.1 – Website Design
- Creation of the overall visual concept and layout of the website.
- Selection of colour schemes, typography, graphics, and other visual elements.
- Designing an intuitive user interface (UI) to enhance user experience.
- Incorporating branding elements to maintain consistency with the client’s brand identity.
2.2 – Website Development
- Building the website using front-end technologies such as HTML, CSS, and JavaScript, etc.
- Implementing responsive design to ensure the website displays correctly on various devices.
- Integrating content management systems (CMS) for easy website management and updates.
- Developing interactive features such as forms, search functionality, and social media integration.
2.3 – Content Creation and Management
- Assisting with content creation, including writing, and editing website copy from online libraries.
- Organizing and structuring content to enhance readability and accessibility.
- Implementing content management systems to enable clients to update and manage their website content.
2.4 – E-commerce Functionality (if applicable)
- Integrating e-commerce platforms to enable online product sales.
- Developing shopping cart functionality, secure payment gateways, and order management systems.
- Creating product catalogues, pricing structures, and inventory management systems.
3. Pricing and Payment
The pricing and payment details for the design package are outlined on our website or as provided to you separately. Payments are to be made as per the specified terms and through the designated payment method.
4. Domain Registration
If you require domain registration services in addition to the design package, JOY INNOVATIONS offers domain registration as a separate service. The cost and details of domain registration are provided separately and are not included in the design package.
5. Domain Ownership
Upon successful registration of the domain, you will own the rights to the registered domain name. However, you acknowledge that domain registrations are subject to the terms and conditions of the domain registrar, and JOY INNOVATIONS is not responsible for any issues or disputes related to the domain registration.
6. Domain Transfer
JOY INNOVATIONS offers domain transfer services with specific conditions. Eligibility requirements set by the domain extension registry must be met, and the domain should be unlocked, privacy protection disabled, and an EPP code obtained from the current registrar. JOY INNOVATIONS provides a user-friendly process with varying transfer timelines. Terms and policies of JOY INNOVATIONS and the domain extension registry apply. It is advisable to review transfer guidelines and consult customer support for more details. Cost and transfer details are provided as per the terms and conditions.
7. Hosting Services
JOY INNOVATIONS, a trusted hosting service provider, offers hosting services subject to specific terms and conditions. These terms govern the agreement between JOY INNOVATIONS and the customer, outlining rights, responsibilities, and obligations. The terms cover aspects such as service level agreements, payment, and billing terms, account usage and responsibilities, as well as data security and privacy measures. JOY INNOVATIONS aims to provide reliable and secure hosting solutions, and it is recommended to review their specific terms and conditions for a comprehensive understanding of the hosting services offered.
8. Client Responsibilities
Content and Materials: As the client, you are responsible for providing all necessary content, text, images, logos, and any other materials required for the website design. It is your responsibility to ensure that you have the necessary rights and permissions for the content you provide.
Timely Cooperation: To ensure the timely completion of the project, you agree to provide timely feedback, approvals, and any requested information or materials needed for the design process.
9. Design Process
Conceptualization: We will provide you with initial design concepts based on your requirements and preferences. You can provide feedback and request revisions during this stage.
Revisions: The design package includes a specified number of revisions such as only one revision allowed upon after the website or any other services are launched or published even it is applicable for posters, gifs, videos, & others within the time frame i.e., 15 days after the launch date. Additional revisions beyond the agreed limit may be subject to additional charges.
Approval and Launch: Once the final design is approved by you, we will proceed with the development and launch of the website. Any further changes requested after this stage may incur additional charges.
10. Intellectual Property
Ownership: Upon receipt of full payment, you will own the rights to the final design of the website, excluding any third-party software, plugins, or other elements used in the development.
Third-Party Materials: If third-party materials, such as stock images or software, are used in the design, their respective terms and licenses may apply. We will provide information about any such materials used.
11. Limitation of Liability
Indemnification: You agree to indemnify and hold JOY INNOVATIONS, its employees, and affiliates harmless from any claims, damages, or losses arising from the use of the website or any content provided by you.
No Guarantees: While we strive to deliver high-quality designs, we do not guarantee specific results or outcomes from the use of the website. We are not responsible for any loss of business, revenue, or damages resulting from the design package or website
12. Termination
Termination by You: If you wish to terminate the design package before completion, you may be subject to cancellation fees or charges for work already completed.
Termination by JOY INNOVATIONS: We reserve the right to terminate the design package and any related services if there is a breach of these terms and conditions or if circumstances arise that prevent us from fulfilling our obligations
